Name, Image, & Likeness (NIL) Policy

Statement of Purpose

IMG Academy is committed to supporting student-athletes in their pursuit of Name, Image, and Likeness (NIL) opportunities in accordance with applicable FHSAA bylaws, applicable state and federal laws, and this NIL Policy. This NIL Policy applies to all student-athletes at the time of their enrollment at IMG Academy through the date of departure from IMG Academy and outlines the expectations surrounding a student-athletes participation in NIL activities, whether compensated or otherwise. While this Policy is created for the benefit of Student-Athletes to empower them to win their future, failure to adhere this NIL Policy may result in discipline in accordance with the Student-Athlete & Parent Handbook.

NIL Defined

NIL activities include any situation where a student-athlete’s name, image, likeness, or personal appearance is used for promotional purposes by an entity other than IMG Academy, whether the student-athlete is compensated or not. Permissible activities include, but are not limited to, commercial endorsements, promotional activities, social media presence, product, or service advertisements.

Disclosure Requirements

IMG Academy encourages Student-athletes to disclose all NIL relationships prior to execution, and requires all NIL relationships to be submitted and uploaded to IMG Academy no later than fourteen (14) days following execution of the NIL activity, or upon enrollment to IMG Academy. This includes contact information for all involved parties, the product and/or services endorsed, and the details of their relationship with these parties. Any amendments to NIL relationships must be disclosed to IMG Academy within fourteen (14) days. The details of all NIL relationships shall be submitted and uploaded to IMG Academy at the bottom of this page within the NIL Disclosure Form.

IMG Academy Marks, Logos and Facilities

Student-athletes are prohibited from making any reference to and will not otherwise use or authorize others to use the uniforms, logos, mascots, insignia, or identifying marks of IMG Academy, the Florida High School Athletic Association (FHSAA), or the National Federation of State High Schools (NFSHS) without prior written consent. The use of IMG Academy’s facilities in NIL activities for commercial purposes is prohibited without prior written consent of IMG Academy. Requests for consideration shall be submitted to IMG Academy by email at [email protected] at least 15 days prior to such requested use.

Restrictions

  1. Conflict with Existing Agreements: Student-athletes may not enter into NIL agreements that conflict with IMG Academy’s existing sponsorships as determined by IMG Academy in its sole discretion. Student-athletes may not engage in NIL relationships that result in marketing efforts by the student-athlete’s NIL partner that may undermine IMG Academy’s relationships with its partners and sponsors. If a student-athlete enters into an NIL relationship with a third-party that conflicts with an IMG Academy partnership/sponsorship, IMG Academy will inform the student-athlete of such conflict so that the student-athlete has the opportunity to timely negotiate a revision of the NIL relationship (with such revision being subject to additional review and approval by IMG Academy.   2. Apparel Contracts: Student-athletes may not enter into an NIL apparel relationship that requires the student-athlete to display a sponsor’s apparel, or otherwise advertise for a sponsor, during official IMG Academy team activities as defined in the IMG Academy Student-Athlete & Parent Handbook, unless such relationship is with IMG Academy’s official apparel sponsor.
  3. Compliance with Dress Code: NIL activities must at all times comply with the "Dress Code" and "Academy’s Sports Program Dress Code" sections of the IMG Academy Student-Athlete & Parent Handbook for the current academic year.
  4. Activities and Accolades: Student-athletes may not endorse or promote any third-party entities, goods, or services during IMG Academy or FHSAA practices, competitions or related activities. Reference to IMG Academy, FHSAA or NFHS accolades, or championships may not be used in the student’s NIL activities for which they are compensated.
  5. Length of Agreement: NIL agreements are limited to a student-athlete’s high school period of athletic eligibility and shall not extend beyond a student-athlete’s high school graduation date.

Prohibited Activities

Student-athletes are prohibited from engaging in NIL activities involving:

  • Adult entertainment products and services
  • Alcohol, tobacco, vaping, and nicotine products
  • Cannabis products
  • Controlled substances
  • Gambling and betting activities
  • NIL collectives
  • Political or social activism
  • Prescription pharmaceuticals
  • Weapons, firearms, and ammunition

Agents

Student-athletes may hire a registered agent to advise ONLY on NIL related matters. Registered agents may not be involved in managing a student-athletes athletic career.
